Terms of Service

1. Scope and Agreement

These Terms of Service govern your use of the mobile application "SalesPush", provided by Christian Knöfel / ProChecked (hereinafter "Provider"). By downloading, installing, or using SalesPush, you agree to these terms and conditions. If you do not agree, do not use the app.

2. Service Description

SalesPush is a mobile application for Amazon sellers that provides:

- Real-time push notifications for new orders
- Sales dashboard with daily revenue, orders, and quantity metrics
- Advanced sales statistics with historical charts (up to 90 days in Pro plan)
- Order history search and filtering
- PDF order summaries (Pro plan feature)
- Support for multiple Amazon EU marketplaces
- Support for both FBA (Fulfillment by Amazon) and FBM (Fulfilled by Merchant) orders

The app integrates with Amazon's Selling Partner API (SP-API) to access your order data. SalesPush is not affiliated with or endorsed by Amazon.com, Inc.

3. Prerequisites and Eligibility

To use SalesPush, you must:

- Be at least 18 years old
- Have an active Amazon Seller Central account in good standing
- Own an iPhone with iOS 16 or later (or Android device with Google Play support)
- Have a stable internet connection
- Authorize SalesPush to access your Amazon order data via OAuth 2.0

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Pricing

Free Plan: Includes push notifications, today's dashboard, and 7-day order history. No credit card required.

Pro Plan: €4.99/month or €39.99/year (33% savings). Includes everything in Free, plus statistics up to 90 days, unlimited marketplaces, PDF exports, daily summary notifications, and priority support.

Billing and Payment: Subscriptions are processed through your device's app store:

- iPhone: Apple App Store
- Android: Google Play Store

Billing occurs monthly or annually depending on your subscription choice. Subscriptions auto-renew unless cancelled. You can manage or cancel your subscription at any time through your device settings.

Price Changes: We may update subscription pricing with 30 days' notice. Existing subscriptions will continue at the current price until renewal.

5. Account Registration and Security

When you register for SalesPush, you provide an email address and password. You agree to:

- Provide accurate and complete information
- Keep your password confidential
- Notify us immediately of any unauthorized access
- Accept full responsibility for all activities under your account

The Provider is not responsible for unauthorized access due to your negligence in protecting your credentials.

6. Amazon SP-API Authorization

SalesPush requests access to your Amazon seller data through Amazon's OAuth 2.0 authorization flow. You authorize SalesPush to access:

- Orders API (to retrieve order information)
- Notifications API (to receive real-time order alerts)
- Catalog Items API (to display product names and details)

Your Amazon password is never shared with SalesPush. You can revoke this access at any time through your Amazon Seller Central account or by deleting the SalesPush app.

7. Limitation of Liability

SalesPush presents order data as provided by the Amazon SP-API. The Provider makes no guarantees regarding the accuracy, completeness, timeliness, or reliability of this data. Amazon may experience delays or outages beyond the Provider's control.

SalesPush is not:

- An accounting or bookkeeping tool
- A tax or financial advisory service
- An official Amazon application
- A substitute for Amazon Seller Central

You should maintain independent records and verify all financial and business-critical data with official sources. The Provider is not liable for any business, financial, or tax consequences resulting from use of SalesPush.

8. Service Availability and Maintenance

The Provider strives for high availability but does not guarantee uninterrupted service. SalesPush may be unavailable due to:

- Scheduled maintenance
- Emergency updates or security patches
- Amazon SP-API outages
- Third-party service failures
- Network or device issues beyond our control

We will make reasonable efforts to notify users of planned downtime, but emergency maintenance may be deployed without notice.

9. Termination of Service

The Provider may suspend or terminate your account if you:

- Violate these Terms of Service
- Engage in fraudulent or illegal activity
- Harm the security or integrity of the service
- Breach your Amazon Seller agreement

Upon termination, your access will be immediately revoked, though you may retain downloaded data for a limited period.

10. User Conduct and Prohibited Activities

You agree not to:

- Use SalesPush for any illegal or unauthorized purpose
- Reverse-engineer, decompile, or attempt to access the app's source code
- Resell, redistribute, or sublicense SalesPush
- Use automated tools to scrape or download data beyond normal app functionality
- Share your login credentials with others
- Use the app to violate Amazon's Seller Code of Conduct or Selling Partner Agreement
- Engage in trademark or intellectual property infringement

11. Intellectual Property Rights

SalesPush, including its design, functionality, trademarks, and content, is owned by ProChecked / Christian Knöfel. You receive a limited, non-exclusive, non-transferable license to use the app for personal business purposes only. You may not modify, copy, or create derivative works without permission.

12. Data Deletion and Account Closure

You can delete your SalesPush account and all associated data at any time by:

- Requesting deletion via email to christian.knoefel@prochecked.info
- Using the account deletion feature in the app (if available)

Upon account deletion, all your data (orders, statistics, credentials) will be permanently erased within 30 days. This action is irreversible. You will still be charged for any active subscription until you cancel it through your device's app store.

13. Warranty Disclaimer

SALESPUSH IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. THE PROVIDER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- ACCURACY OR COMPLETENESS OF DATA
- UNINTERRUPTED SERVICE
- FREEDOM FROM DEFECTS OR VIRUSES

14. Limitation of Damages

IN NO EVENT SHALL THE PROVIDER BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR SOLE REMEDY FOR DISSATISFACTION WITH SALESPUSH IS CANCELLATION OF YOUR SUBSCRIPTION AND DELETION OF THE APP.

15. Indemnification

You agree to defend, indemnify, and hold harmless the Provider from any claims, damages, liabilities, and costs arising from:

- Your violation of these Terms of Service
- Your use or misuse of SalesPush
- Your infringement of any third-party rights
- Your breach of your Amazon Seller agreement

16. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nürnberg, Germany. If you are a consumer, you may also pursue claims in your local courts.

17. Dispute Resolution

Before initiating legal proceedings, you agree to contact the Provider at christian.knoefel@prochecked.info to attempt to resolve any disputes informally.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be removed or reformed to the minimum extent necessary, and the remaining provisions will remain in effect.

19. Entire Agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and the Provider regarding SalesPush and supersede all previous agreements and understandings.

20. Changes to Terms

The Provider may update these Terms of Service at any time. Material changes will be communicated via email or through the app. Your continued use of SalesPush after such changes constitutes your acceptance.
